Understanding if you qualify for ILR under domestic violence provisions
1. Relationship Status
You must have been in the UK on one of the following visas:
- •Spouse or civil partner visa (married or in civil partnership)
- •Unmarried partner visa (2+ years living together)
- •Same-sex partner visa
- •Proposed civil partner or fiancé visa (if relationship broke down after arrival)
2. Domestic Violence or Abuse
Your relationship must have broken down permanently due to domestic violence or abuse. This includes:
- •Physical abuse: Any form of physical violence or harm
- •Psychological/emotional abuse: Threatening behavior, intimidation, coercive control
- •Financial abuse: Controlling access to money, preventing work
- •Sexual abuse: Any non-consensual sexual activity
- •Controlling behavior: Isolation from friends/family, monitoring communications
- •Coercive behavior: Threats, humiliation, intimidation over time
3. Evidence Requirements
You need to provide evidence from one of these sources (you don't need all of them):
- •Court documents: Injunction, restraining order, non-molestation order, occupation order
- •Police evidence: Crime reference number, police caution, arrest, charge, or conviction
- •Medical reports: GP or hospital records documenting injuries or psychological harm
- •Social services: Letter from social services confirming DV concerns
- •Domestic violence support organization: Letter from refuge, Women's Aid, or similar organization
- •Multi-agency risk assessment: MARAC meeting notes or referral

4. Other Requirements
- No financial requirement: Unlike standard ILR, there is NO minimum income or savings requirement
- English language: You must meet the B1 level English requirement (unless exempt)
- Life in the UK test: You must pass the Life in the UK test (unless exempt due to age or medical reasons)
- Good character: No serious criminal convictions (defensive actions against abuser are considered)
